Terms and Conditions
1. Scope of Services:
● Jack Spokes PT provides personalized fitness training services tailored to the individual needs and goals of the client, as agreed upon in the initial consultation.
2. Client Responsibilities:
● Clients are responsible for attending scheduled training sessions promptly and providing accurate health information. Clients must follow the trainer's instructions during sessions.
3. Health and Safety:
● Clients acknowledge the importance of consulting with a healthcare professional before starting a fitness program and agree to inform Jack Spokes PT of any health concerns or changes during the training period.
4. Payment and Refund Policy:
● 4.1 Payment terms
○ Online and hybrid coaching: Membership must remain current to receive member benefits (including discounted session rates and training app access).
○ In-person sessions: All sessions must be paid in full prior to the scheduled session time. Sessions will not proceed unless payment has been confirmed.
● 4.2 Late Payments:
○ All payments must be received before the commencement of the billing period or any session.
○ Failure to pay on time may result in session cancellation and/or refusal of future services.
○ Repeated failure to pay on time may result in service suspension or termination.
● 4.3 Money-Back Guarantee (New Client Policy):
○ New clients are eligible for a full refund within the first 7 days of their initial training purchase, provided:
○ No more than two sessions have been completed, and
○ The client communicates dissatisfaction in writing to Jack Spokes PT within the 7-day period.
○ If notice is not received before the next billing cycle, one final billing period will apply, and cancellation will take effect thereafter.
○ Refunds under this guarantee will be processed within 7 business days of the written request. This guarantee applies only to a client's first purchase and cannot be claimed multiple times.
● 4.4 Standard Refund Policy:
○ Beyond the 7-day guarantee period, all payments are non-refundable, except in the following circumstances:
○ A medical condition, injury, or illness that prevents continued training (with supporting documentation such as a medical certificate).
○ Permanent relocation beyond a reasonable travel distance from the training facility.
○ Exceptional personal circumstances at the discretion of Jack Spokes PT.
○ Approved refunds will be calculated on a pro-rata basis, deducting the cost of any completed sessions.
● 4.5 Late Arrival Policy:
○ Clients who arrive late to a scheduled session will receive training for the remainder of the allocated time only. Additional time will not be added unless the trainer’s schedule allows.
● 4.6 Session Transferability
○ Purchased sessions are non-transferable unless agreed upon in writing by Jack Spokes PT.
5. Cancellation Policy:
● 5.1 Client Cancellations:
○ Clients must provide at least 24 hours notice for session cancellations. Cancellations made within 24 hours will incur a full session fee unless in cases of emergency. Missed sessions without proper notice are non-refundable.
● 5.2 Trainer Cancellations:
○ If Jack Spokes PT cancels or reschedules a session with less than 24 hours’ notice, clients will receive either a full refund or a credit applied to their next session.
6. Scheduling and Rescheduling:
● Clients can schedule sessions by contacting Jack Spokes PT. Rescheduling requires 24 hours notice. Sessions are subject to availability and may be adjusted in case of unforeseen circumstances.
7. Termination of Services:
● Either party may terminate the training relationship at any time.
● Online and hybrid coaching: Cancellation requests must be submitted in writing at least 7 days before the next billing date. If notice is not received, one final billing cycle will be charged, and cancellation will take effect thereafter.
● Jack Spokes PT reserves the right to terminate services immediately for repeated no-shows, policy violations, or non-payment.
8.Programs, Materials and Promotional Offers:
● 8.1 Nature of Services:
○ These offers may include digital materials, single sessions, short-term training plans, or event-based promotions.
● 8.2 Access:
○Access to any digital or written material is for personal use only and may not be copied, distributed, or resold.
● 8.3 Payment & Refunds:
○Payment must be made in full at the time of purchase. Unless otherwise stated at the point of sale, these purchases are non-refundable.
● 8.4 Expiry:
○Where applicable (e.g. a single session or time-limited package), services must be used within the stated period from the date of purchase.
● 8.5 Liability:
○All disclaimers and risk acknowledgements set out in these Terms also apply to any one-off or promotional services.
9. Insurance:
● Jack Spokes PT is an independent sole trader. Personal training services may be delivered within commercial gyms, fitness studios, or other approved facilities. Jack Spokes PT maintains current professional indemnity and public liability insurance at all times.
10. Code of Conduct:
● Both clients and Jack Spokes PT agree to maintain a professional and respectful demeanour during training sessions. Jack Spokes PT reserves the right to terminate services for inappropriate behaviour.
11. Intellectual Property:
● Any training programs, materials, or intellectual property developed during the course of the training relationship are the exclusive property of Jack Spokes PT.
12. Results Disclaimer:
● While Jack Spokes PT will provide professional guidance and support, results may vary based on individual effort, adherence, and health factors. No specific outcomes are guaranteed.
13. Liability Waiver:
● Clients understand that participation in physical activity involves inherent risks including, but not limited to, muscle soreness, injury, or adverse health events. By participating, clients voluntarily assume these risks and waive the right to hold Jack Spokes PT, its trainers, or associated facilities liable for any injury, loss, or damage.
14. Emergency Health Disclosure:
● In case of a medical emergency during a session, Jack Spokes PT will take reasonable steps to ensure the client’s safety, including contacting emergency services if necessary.
15. Amendments to Terms:
● Jack Spokes PT reserves the right to update these terms and conditions. Clients will be notified of any changes, and continued use of services implies acceptance of the updated terms.
16. Governing Law:
● These terms and conditions are governed by the laws of Australia. Any disputes will be handled under Australian law.
Privacy Policy
1. Information Collected:
● We may collect your name, contact details, payment information (processed securely via third-party providers), health history, training progress, and other information relevant to providing personal training services.
2. Use of Information:
● This information is used to deliver and manage training services, process payments, communicate with you, and comply with legal requirements.
3. Data Sharing:
● Your information will not be sold or shared with unrelated third parties. We may use secure third-party services (e.g., Stripe for payments) in order to provide services.
4. Confidentiality:
● All personal and health-related information will be kept strictly confidential. Clients also agree not to disclose proprietary training methods or materials without permission.
5. Data Security:
● We take reasonable steps to protect your information from loss, misuse, or unauthorized access.
6. Your Rights:
You may request access to, correction of, or deletion of your personal information at any time by contacting us.
